"Mucho se ha debatido sobre la limitación de la fianza en un país en que los criminales ‘campean por su respeto’. Aquí tenemos otro ejemplo más de lo que llamé en una columna de El Vocero ‘La Isla del NO’. Unos se oponen en una ocasión a una cosa, otros a otra, y otros a todo.
Si absurdo es que malhechores y mequetrefes ya no respeten siquiera la vida de niños inocentes, de jóvenes estudiantes, madres solteras y ciudadanía en general, más absurdo me parece que su ‘derecho’ a estar en la libre comunidad, luego de cometer un crimen atroz, vaya por encima de la vida de Stefano, del discjockey de Cidra, de los que intentaron asesinar una bebé de meses ¡en dos ocasiones! en pleno expreso Las Américas, o la niña inocente de tres años que recibió un balazo en el ojo y lo perdió. Para un sector del País, los ‘derechos’ de esos asesinos son una prioridad porque supuestamente salvaguardan el suyo.
¿Ha leído usted a quienes les aplicaría la limitación de la fianza? Si no, pues aquí se las expongo:
(1) A los acusados de asesinato cometido con premeditación, deliberación o acecho. ¿Sería usted capaz de conspirar y organizar un asesinato? ¿Mataría a otro ser humano? ¿Sí o No?
(2) A los acusados de asesinato cometido en medio de un robo en el hogar; acusado de asesinato cometido en el curso de una agresión sexual o secuestro. ¿Se metería usted en una casa ajena con una ‘9 milímetros’ para robar y mataría al que sea? ¿Asesinaría a una mujer o un niño en medio de una violación sexual? ¿Le ‘volaría la tapa de cesos’ a un ser humano que tenga secuestrado? (primero pregúntese si sería capaz de secuestrar a alguien). ¿Sí o No?
(3) A los acusados de asesinatos cometidos al disparar un arma de fuego desde un vehículo de motor o en un lugar abierto al público, poniendo en riesgo la vida de más de una persona. ¿Dispararía usted un revolver al aire en la Baldorioty de Castro o contra otro vehículo poniendo en peligro la vida de los demás? ¿Abriría fuego contra unos niños y adultos que juegan ‘pelota’ en un parque? ¿Sí o No?
(4) A los acusados del asesinato de un agente del orden público que se encuentre en el cumplimiento de su deber. ¿Se iría usted a tiro limpio con un policía hasta matarlo? ¿Sí o No?
La Ley Habilitadora para el Referéndum constitucional sobre la Fianza indica, y cito: “esta Asamblea Legislativa aprobó una resolución concurrente autorizando que todo acusado tendrá derecho a quedar en libertad bajo fianza antes de mediar un fallo condenatorio excepto…” los que cometan los delitos antes mencionados.
Si usted contestó ‘No’ pues sencillamente siga comportándose como un buen puertorriqueño, trabajador, honesto y luchador como somos la mayoría. Si usted sería capaz de cometer cualquier delito de los antes mencionados, si usted es un abogado que vive de mantener en la calle a los asesinos o si es sencillamente uno de los que se opone porque hay que oponerse a todo o casi todo lo que proponga el Gobierno, pues luche con todas las fuerzas de su alma por mantener su ‘derecho’ que por default es el de los que matan niños, mujeres y hombres inocentes, que es el mismo ‘derecho’ suyo (el de la fianza absoluta). Después que le ate las manos a la sociedad víctima del crimen, entonces no venga con el llorao’ de que esto está manga por hombro. Obviamente esa medida, por sí sola, no va a acabar con el crimen. El ‘escaneo’ de furgones por sí solo no va a acabar con el crimen. Tampoco el forrar las costas de guardias nacionales va a acabar con el crimen por sí solo. Las rondas preventivas, el esclarecimiento de los casos; nada, ninguna medida por sí sola va a acabar con este mal, pero estoy convencido que si las vamos juntando todas, algo positivo tiene que pasar. NO podemos seguir oponiéndonos por oponernos a todo.
Hacemos campañas contra los intentos de un gobernador para detener o reducir la criminalidad. Cada uno de los que se oponen, cuestiónese: ¿cuantas veces se ha metido en una zona de alta incidencia criminal a luchar contra las acciones de esos asesinos? ¿Es muy peligroso meterse en esas zonas? Bueno, pues… ¿qué ha hecho fuera de esas zonas contra la criminalidad? ¡Ah!, y campañas efectivas, porque si queremos que el gobierno, sea popular o penepé, haga cosas efectivas, pues nosotros no debemos exigirnos menos a nosotros mismos. ¿Que usted no puede hacerlo solo? El gobierno tampoco. ¡Esto depende de TOD@S! ¿Dónde están los paladines de Vieques?
Hablando de la Isla Nena, ¿cuál es la similitud y la diferencia entre el caso de Vieques y la criminalidad que nos arropa? La similitud es que mueren personas. En el caso de Vieques morían de cáncer y en el de la criminalidad por las balas sin nombre que nos pasan por la sien. En Vieques morían víctimas inocentes y por la criminalidad también. ¿La diferencia? ‘Primero Vieques, luego Puerto Rico’. ¿Recuerdan esa frase? La parte de la salud fue el ‘medio’. La parte ideológica era el ‘fin’. ¿Recuerdan cuando se hablaba de los peligros de hacer mucho contacto con el agua y con los terrenos contaminados? Ahí sacaban ‘pecho e’ paloma’ diciendo que darían hasta la última gota de sangre por la salud y la seguridad del pueblo viequense. ¿Donde están hoy? ¿Ha visto usted hoy a alguno de esos que esté dispuesto a dar hasta la última gota de sangre combatiendo a esos infelices que atentan contra los que trabajan y viven honradamente? ¡Ahhhh, nooo! Para eso está el gobierno. Ahí ‘ni con una vara larga’. Que bien que lucharon por Vieques bajo el sol. Con la criminalidad hay que tomarse riesgos pero NO voy a elegir el riesgo de que mis hijos, mi esposa o mis seres queridos sean asesinados en nuestras calles o en nuestros hogares. ¿Qué riesgo se tomará usted? ¿Qué riesgo eligirá por sus hijos el próximo 19 de agosto? Como cuestión de hecho, el que la fianza sea restringida o limitada a un vil asesino, no quiere decir que saldrá culpable. La fianza se utiliza mayormente para garantizar la comparecencia de un acusado. En este caso, en vez de garantizar la comparecencia, en estos casos se limitará para reducir la posibilidad de poner en peligro a la ciudadanía.
